Ralph Mariano and his father, Ralph Mariano, Jr., both arraigned in the Navy kickback case, have requested to waive a jury trial. They are scheduled to appear in court on Friday to address the request, said Jim Martin, Public Information Officer at the U.S. Attorney's Office. The younger Mariano allegedly accepted kickbacks of naval funds from Advanced Solutions for Tomorrow (ASFT), a Middletown company. ASFT had about $128 million in Navy contracts when it closed. Lawyer Mary O'Rourke is scheduled to be arraigned in court today on charges of conspiracy and theft of government property, reports The Providence Journal. O'Rourke, a former employee of Advanced Solutions for Tomorrow (ASFT), a Middletown company, is being arraigned in connection with an alleged U.S. Navy kickback scheme. Ralph Mariano of Virginia is also expected to appear in court on arraignment later this month. A federal grand jury in Providence today issued a 37-count indictment against one of the main suspects in the Navy kickback scheme, while also issuing charges against the suspect's father. A release from U.S. Attorney Peter F. Neronha outlined multiple charges against 54-year-old Ralph Mariano of South Arlington, VA, who worked as a civil engineer with the Navy's Naval Sea Systems Command (NAVSEA) in Newport. Those charges include conspiracy, theft of government funds, extortion, and multiple counts of wire fraud and tax evasion. A Portsmouth man pleaded guilty Thursday to lying to the FBI during the investigation into an alleged Navy kickback scheme. Russell E. Spencer, 57, of Portsmouth, a sub-contractor, appeared in U.S. District Court Thursday before U.S. District Court Chief Judge Mary M. Lisi. Spencer admitted he lied to investigators and prosecutors on three occasions between September 2011 and January 2012 about a relationship he had with another person, and that he provided gifts and monies to that person from proceeds he realized from the kickback scheme. A Portsmouth man, who admitted in June to being involved in an alleged Navy kickback scheme, has agreed to plead guilty to lying to the FBI during the investigation. A federal prosecutor is seeking a sentencing delay for Patrick Nagle, the director of a company formerly based in Middletown, who admitted to funneling nearly $20 million in federal Navy funds. The Providence Journal reports that Assistant U.S. Attorney Dulce Donovan is asking Nagle's sentencing be delayed 120 days past its current March date. Nagle pleaded guilty in the Navy kickback scheme last August. He held the position as senior vice president at ASFT, which had operations based out of Middletown and Roswell, GA. Nagle also served as the company's director of contracts. Projo.com reports that a Portsmouth man entered a guilty plea late Friday afternoon in connection with the multimillion-dollar Navy kickback case. Russell Spencer of Portsmouth was charged previously with one felonious count of conspiracy to commit bribery. He pleaded guilty to the charge on Friday.
