At the Courts: Newport Crack Dealer Sentenced

The following cases were decided at the Superior Court and Second District Court in Newport on Thursday, Nov. 18, 2010.

 

The following actions were taken in Second District and Superior Court on Thursday, Nov. 18. The following information was provided solely based on court records:

Superior Court:

  • George Glover, 32, of 15 Meeting St., Newport, formerly of Middletown, entered a new plea of nolo contendre (no contest) to Newport Police Department allegations of manufacturing and delivering "crack" cocaine that date back to 2008. According to court records, Glover's arrest followed undercover narcotics operations that had involved him on May 6 and June 30 of 2008 near the Newport Heights Housing development. Glover was ordered to serve 18 months of an eight-year sentence, with credit for time already served, and he received a 78-month suspended sentence with 78 months on probation.
  • Richard Walker, 42, of 195 Kalfbus Road, #18E, Newport, pleaded nolo contendre to charges stemming from his arrest by Rhode Island State Police on Feb. 6, 2010 for possession of a controlled substance without a prescription (11 Vicodin tablets) and driving under the influence, a first offense. Walker was sentenced to 18 months probation to the first count related to the Vicodin charge and, to the second DUI count, he received a six-month license suspension, was ordered to perform 10 hours of community service, and ordered to attend DUI school.

Second District Court:

  • Portsmouth Police Department charges of domestic assault and battery against Carl Dixon Bailey, 52, of 96 McIntosh Drive, Portsmouth, were dismissed Thursday. The charges, to which he had pleaded not guilty, stemmed from an incident that reportedly occurred Oct. 24, 2010 involving a 38-year-old female.
  • In entering a plea of nolo contendre (no contest) to a Portsmouth Police Department charge of domestic assault and battery related to his arrest on Sept. 5, 2010, Ryan J. Kirtland, 24, of 22 Lakeville Ave., Portsmouth was ordered to have no contact with the victim, undergo alcohol counseling, and was placed on six months of probation.
  • A Portsmouth Police Department charge of simple assault and battery against William George Whitmarsh, 46, of 72 Pier Road, Prudence Island, was dismissed. Whitmarsh had pleaded not guilty to the allegation that had led to his arrest on Jan. 22, 2010 involving an alleged altercation with a 40-year-old male.
  • A Portsmouth Police Department charge of an alleged dog license violation from Sept. 14, 2010 against Linda Renee Binette, 42, of 51 Rhode Island Blvd., Portsmouth was ordered to be dismissed upon payment of a $25 fine and $100 contribution to the VCIF fund.
  • A Middletown Police Department charge of domestic assault and battery was dropped against Andrew J. Ripa, 19, of 11 Paquin Place, Middletown after he pleaded nolo contendre to the allegation, which stemmed from an alleged incident on June 13, 2010 involving a 43-year-old woman. Ripa was ordered to have no contact with the woman, pay restitution to be determined, and attend domestic violence counseling.
  • A Tiverton Police Department charge of domestic simple assault against Gail Marie Cline, 48, of 260 Souza Road, Tiverton, was dismissed. The initial charge involving an alleged female victim of unknown age had been filed against Cline on Nov. 14, 2010.
  • Conor Dillon Carr, 26, of 59 Chapel Terrace, Newport, pleaded nolo contendre to a Portsmouth Police Department charge of driving with a suspended license on Sept. 25, 2010 and was ordered to pay a $250 fine plus court costs, for a total of $352, with no further loss of license.
  • A Portsmouth Police Department charge of driving with a suspended license against Jacob Roy DeCastro, 20, of 991 Middle Road, Portsmouth, was dismissed after he pleaded nolo contendre to the offense, which allegedly occurred July 1, 2010. He was ordered to pay a total of $94.50 in court fines and fees.
  • Brian Fischer Davis, 19, of 2 Woods End, Needham, MA, pleaded nolo contendre to a Portsmouth Police Department charge of driving under the influence of alcohol on Oct. 29, 2010. His driver's license was suspended for three months and he was ordered to pay a $100 fine plus court costs, for a total of $780.50, perform 10 hours of community service, and attend DUI education.
  • Stemming from a Portsmouth Police Department charge of driving under the influence of alcohol issued on April 18, 2010, Joseph Michael Novo, 33, of 50 Bright St., Unit #2, Fall River, MA, pleaded nolo contendre and agreed to a dismissal of the charge with a $100 fine plus court costs, for a total of $580.50, perform 10 hours of community service, and receive a 30-day license suspension.
  • A Tiverton Police Department charge of driving with a suspended license on Sept. 20, 2010 was ordered to be dismissed against Colin David Tabicas, 22, of 2101 GAR Highway, Swansea, MA, upon payment of a $250 fine plus $94.50 in court fees. Tabicas had pleaded nolo contendre.
  • Chondra Olympia Straton, 23, of 1359 Plymouth Ave., Apt. #3N, Fall River, MA, pleaded nolo contendre to a Portsmouth Police Department charge of driving under the influence of alcohol on Nov. 18, 2010. Her driver's license was suspended for three months and she was ordered to pay a $100 fine plus court costs, for a total of $780.50, perform 10 hours of community service and attend DUI education.
  • A Portsmouth Police Department charge of obstructing a police officer was dismissed against Matthew William Reynolds, 29, of 18 Beach View Terrace, Middletown. Reynolds had pleaded not guilty to the allegation from Sept. 27, 2010.
  • India C. Small, 24, of 96A Water St., Newport, entered a nolo contendre plea to a first offense charge issued by the Portsmouth Police Department of driving under the influence of alcohol related dating back more than a year ago to June 13, 2009.  Small received a three-month license suspension and was ordered to pay a $500 fine plus court costs, for a total of $1,225.50, perform 20 hours of community service and attend DUI education.
  • A Portsmouth Police Department charge of marijuana possession that had been issued Oct. 17, 2010 against Luis H. Pires, 33, of 28 Dennison St., Newport, was dismissed with Pires ordered to pay $93.50 in court costs.
  • Gregory Scott Harrington, 23, of 14 Mohawk Road, Canton, MA, pleaded nolo contendre to a Portsmouth Police Department charge of reckless driving on Oct. 31, 2010 and was ordered to pay a $250 fine plus court costs.
  • Carlos Veliz, 18, of 111 Beacon St., Worcester, MA, pleaded nolo contendre to a Tiverton Police Department charge of driving without a driver's license on Oct. 7, 2010. He was ordered to pay a $250 fine plus court costs, for a total of $352.50, with no further loss of license.
  • Ramondo Antonio Howard, 36, of 119 Park Holm, Newport, was arraigned on a Newport Police Department felony charge of breaking and entering a dwelling without consent, stemming from his arrest on Nov. 17, 2010 which involved the residence of a 30-year-old woman at 78 Park Holm, Newport, with whom he had a "dating relationship," according to court records. Bail with surety was set at $10,000.
